LOL I wish that were true ! 2014 Elddis Crusader Shamal leaking water in front left hand side of roof area plus various other faults, Elddis plus dealer don't want to know

Total Elddis rubbish caravan !

 

It is the responsibility of the dealer to sort out any damp ingress under Sale of Goods Act. Rubbish dealer I would think. See the following;

 

Sale of Goods Act Key Facts:

 

1 Wherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i. e. not inherently faulty at the time of sale).

 

2 Goods are of satisfactory quality if they reach the standard that a reasonable person would regard as satisfactory, taking into account the price and any description. Aspects of quality include fitness for purpose, freedom from minor defects, appearance and finish, durability and safety.

 

3 It is the seller, not the manufacturer, who is responsible if goods do not conform to contract.

 

4 If goods do not conform to contract at the time of sale, purchasers can request their money back "within a reasonable time". (This is not defined and will depend on circumstances)

 

5 For up to six years after purchase (five years from discovery in Scotland) purchasers can demand damages (which a court would equate to the cost of a repair or replacement).

 

If the caravan has been serviced regularly and it has suffered from water ingress this would be an inherent fault that was there at time of manufacture. Can I suggest you contact Which legal to determine your rights and you may be pleasantly surprised at what you can claim for under SOGA? Don't let the dealer get away with fobbing you off.

Playing devil's advocate here.

 

Are you certain the water is getting in through a panel joint, or is it getting past a window seal. If the former then it's a SOLID problem but AFAIK windows are still fitted as they have been on all vans for years and the seals leak sometimes. In any case it needs to be sorted by the dealer. How he reconciles it with Elddis is really no concern of yours.

Correct but to put you on the correct track the initial advice is free. If you want to use it more it costs under £8 a month including the magazine and you can cancel at any time. I estimated that over the past few months advice from Which Legal has saved us several thousand so well worth the £8 a month.
