Success At Last!

It's 2years, 2months, and 2weeks to the day since our car was written off by an out of control oncoming car in Italy.

 

We have today received a final cash settlement for injuries and lost earnings (while my wife and I recovered) from AXA Italia. It's taken medical examinations, photographs of various parts of our respective anatomies and the intervention of an Italian medical claims specialist to finally get them to make a sensible and acceptable offer.

 

The offer came on the afternoon before my solicitor had to pay the court fee that would formally start court proceedings. Talk about brinksmanship.

 

After deducting the solicitors success fee (25%) we have an amount that covers all our losses and expenses. ....and gives us a reasonable additional amount for the 'pain and suffering'.

 

We can now put this episode behind us and move on. Just a shame they didn't agree to this 2years ago after the Carbinieri report totally exonerated us, putting all the blame squarely on the wreckless Italian driver.

 

It's been a long haul. ..but a weight has been lifted of our shoulders. Phew!

The most important thing has always been the health and well being of yourself and your wife, but I am delighted that you finally have "settlement".

Just a great shame that you had to forfeit 25% to solicitors!

It took us 18 months to get a settlement after an at fault Spanish driver ran into the back of our car. Fortunately we were unharmed and the car was drivable. Goodness knows how long it is going to take once we have officially left the EU.

I'm glad it's finally sorted and you are satisfied with the outcome, I think I remember you saying you were thinking of walking away because of the stress it was causing you and your wife, so I'm really happy you didn't give in earlier. Good luck for the future

Yes you are absolutely right. ..I was really down at one stage. What spurred me on was the scarring left on my wife's neck. She is a bit self conscious about it ( doesn't bother me!) It was a result of the accident and the subsequent incompetent treatment by a dispassionate Italian hospital.

( NB ladies don't wear thin necklaces UNDER your seat belt. ..they can act as a garrotte when tumbling around in a car crash!)

 

The scarring is the only remaining and enduring momento of the accident.

But their initial medical assessment failed to accept the mental angst it caused.

They asked me for photos of the scarring at arms length and at several distances 'further away'. I told them to b*gger off as it was only when people were close that mattered. I told them I would have a plastic surgeon consultant quote for complete plastic surgery of the neck. ..if they would prefer that resolution and cost!! They doubled their offer. ...surprise surprise.

Yes. ...all their costs, medical examiners fees etc etc paid by the defendants. ...PLUS 25% 'success fee' from my award.

 

But I am content with 75%.

 

It wasnt the money so much. ..more a case of AXA Italia being held accountable for their insured drivers actions.

Well done and thank you for standing up for your rights. The more people do the more it will cost these companies. Then they will hopefully change their ways.

Please tell your wife not to be self-concious of any scaring, I too have some minor scars on my face, a bigger one on my collar bone (from a drunken ex smashing the car window in on me in temper) and a large one on my upper arm from being bitten by a horse fly when I was a baby (I'm 47 now and as I got bigger so did the scar) - I can honestly say most people don't immediately notice them like you think they do. To you, they are all you see, they're huge and angry looking and you feel they dominate you as a whole, but any one who is meeting you for the first time is usually looking at your eyes or your welcoming smile :D

 

Yes they may notice them as a later point and be curious, but thats OK, curiousity is natural. ....wouldn't you be curious??? I know I would be, curiosity is not bad. You wife has a story of caution and survival which could help someone in the future. ..you've done it already by warning people not to wear their necklaces under seatbelts - so it's helping already.

 

Please tell your wife she is strong and beautiful and a bit of discolouration and skin puckering doesn't diminish that in anyway and never will :wub:
